The illegal copying and adoption of foreign services is demonstrated with various terms: Counterfeiting, plagiarism, etc. In the public and academic debate, the terms product and brand piracy have prevailed. Brand piracy is understood as the imitation of trademark rights. Product piracy therefore as the imitation of products, no matter if in addition there is an imitation of the brand.
Plagiarism can be distinguished by how the counterfeiters bring the original manufacturer in relation to their own counterfeit goods:
Brand- and Product Piracy: counterfeit products, which should not be recognized as fake.Consumers should believe that it was the branded product. The product and the brandlogo are imitated. Only the price differs from the original. Examples: fake Rolex watchesand fake Lacoste t-shirts.
Piracy with respect to the brand: Plagiarism that is copying of the product and change thebrand. The product name and the brand logo are modified, but remember the original.Examples: Bucksstar Coffee (instead of Starbucks Coffee), Haagen Bozs (instead of Haagen-Dazs) and Adidos (instead of Adidas).
Piracy without reference to the brand: Imitations which imitate the product, but not thebrand. The counterfeit products are offered under another product names and logo. Example: salt and pepper shakers from Koziol were copied by the Italian company Due Esse and sold under its own name.
